We've all heard horror stories of insane neighbors making life hell for others. There are even TV shows that focus on bad neighbors. While the extreme cases are the ones that make the news, it's also very common to have minor disagreements with those who live closest to you.
Maybe the guy next door likes to make roof repairs at 6:00am or blows leaves out of his yard and into yours. Maybe the neighbors don't like it when you have fifty of your best friends over and blast music late at night. First up, we're not talking about all pot charges. If you're caught with 20 pounds of weed, you're likely a drug dealer and this post doesn't apply to you.
But if you're caught with only enough marijuana to roll a couple of blunts, chances are the charges can be tossed. Law enforcement officers are given a lot of discretion when making an arrest. After all, we expect them to protect us from violent individuals.
That means police can use a reasonable amount of force to restrain someone who is resisting arrest. But they must use the least amount of force necessary to get the job done. Anything more is considered excessive force. |
